I finally have a blackjack 2 after wanting one for sometime. However, ATT is doing their best to ruin my newfound happiness. Although I have the IMEI and unlock code I can't use my sim card in the blackjack 2 unless I sign up for their 30 dollar a month data package. As a broke college student that extra $30 just isn't happening. Is there a way to get around this or am I doomed to be stuck with the phone that came free with signing up. Any iformation you can give would be helpful.

How did you approach this?  Did you call them to turn it on and make them aware that you were no longer using your old phone?

When I was given mine by my boss, I slipped in the SIM from my LG Vu and away I went.  For months I used just the $15 data/msg plan, but the 5Mb wasn't enough, so I upgraded to the $30 data/msg plan.

Technically, even then I was getting away with it since they are supposed to charge you the PDA data plan ($30) plus the messaging plan on top of that ($15-20).  I didn't even know this until I upgraded to the iPhone….I thought I was doing it on the up and up.  Oh well.  Their loss.

If I were you, I'd call back and tell them that you're not willing to pay the data charges and you want to reactivate your old phone (find one from a friend, if need be).  Then, just swap the active SIM into the BJII and run with it.

The ATT system is now such that it can detect what phone you are using.  I have been using my BJ2 for a while without a data plan.  I recently had to switch back to my Razor when I ran my BJ2 battery down.  When I switched back to my BJ2, I got an email notifying me that they had added a data plan because I was using a smartphone.

I called and said I didn't want the data plan and would just use the Razor if the BJ2 required a data plan.  They ended up adding what they referred to as an "exception" on my account.  Apparently if you were using a smartphone without a data plan prior to some magic date, you aren't required to have one.  Otherwise, any use of a smartphone requires a data plan.

They gave me some song and dance about all other carriers already doing this.  I tried to find out whether buying an unlocked device and just swapping sim cards would remove this exception or whether it was only removed if I activated a new contract with ATT but couldn't get a straight answer.

This was all discussed in more detail in another thread, I think.

I got my BJ2 in Jan 2009 at Walmart and at the time AT&T did not require a data plan.  I was fine with that because my last job gave me a blackberry with data and email.  But when I moved I got the data plan added.  I used the tether hack found on this website to tether my phone to my laptop when I am in class.  This is the first time that I have gone over a gig of data.
